TERMS & CONDITIONS

1. Registration and Indemnity

1.1 All students must be registered by a parent or legal guardian through the official online portal at www.onewithwater.co.za.
1.2 By completing registration, the parent or guardian acknowledges and agrees to these Terms and Conditions, the published Indemnity, and any related policies, all of which may be amended annually at the discretion of One With Water (“the School”).
1.3 Indemnity forms must be re-executed on an annual basis. No exceptions to these registration requirements shall be permitted.

2. Fees

2.1 All fees are invoiced and become payable at the commencement of each calendar month.
2.2 Invoices shall be issued on the 25th day of each month for the subsequent month and are payable upon receipt. Failure to remit payment by this deadline may result in cancellation of lessons for that month.
2.3 Fees are subject to review and adjustment annually, effective 1 August of each year.

3. Lesson Bundles

3.1 Lessons are offered in packages of four (4) or eight (8) sessions, allowing for attendance once or twice per week.
3.2 In months where a student’s regular lesson day occurs five (5) times instead of four (4), the corresponding invoice shall reflect the total number of lessons scheduled.

4. Lesson Bookings

4.1 Each student’s lesson time and assigned coach shall be scheduled on a monthly basis.
4.2 Coaches are remunerated regardless of student attendance.
4.3 Cancellations or rescheduling requests must be submitted no less than twenty-four (24) hours prior to the scheduled lesson.
4.4 Lessons missed without prior notice shall be deemed as delivered and are neither refundable nor transferable.
4.5 Make-up lessons may be arranged for illness only, provided they are completed within the same calendar month.

5. Weather Policy

5.1 The School’s pool is indoor and heated; lessons shall proceed under normal weather conditions.
5.2 In the event of a lightning storm or other hazardous conditions occurring during a session, the attending coach shall have sole discretion to postpone lessons.
5.3 Make-up lessons shall not be provided for weather-related postponements unless, in the coach’s discretion, it is safe to resume lessons.

6. Operating Hours

6.1 One with Water operates year-round, excluding public holidays, Easter weekend, and the annual December/January holiday period.
6.2 Lessons scheduled on these excluded dates shall either be rescheduled or not charged, at the school’s discretion.

7. Administrative Fees

7.1 An annual administrative fee of R300 per student is payable at the time of registration and each subsequent September.
7.2 This fee contributes to administrative operations and pool/equipment maintenance.

8. Cancellation Policy

8.1 Invoices are issued on the 25th day of each month.
8.2 To cancel lessons without incurring charges, written notice must be provided no less than thirty (30) days in advance.
8.3 Lessons continue through the winter period unless written notice is sent to andrea@poorter.co.za prior to 1 April, failing which a one-month fee shall apply.

9. Medical Conditions

9.1 Parents or guardians must disclose in writing any medical condition, illness, allergy, or health issue that may impact the student’s participation in swimming lessons.

10. Model Release and Use of Photographs

10.1 Parents or guardians grant the school permission to photograph and record video of their child during lessons for use in marketing materials, including but not limited to print, online, presentations, and social media.
10.2 Such materials shall remain the property of One with Water unless written notice is provided to withdraw consent.

11. Pool Etiquette

11.1 Students may enter the reception area no more than ten (10) minutes prior to their scheduled lesson.
11.2 Late arrivals exceeding ten (10) minutes for group lessons shall not be permitted to participate, and the lesson shall be forfeited.
11.3 Only registered students cleared by security may enter the pool area. Parents/guardians are not permitted within the training zone unless explicitly authorized by the coach.
11.4 Siblings and friends must refrain from entering the teaching zone or causing distractions.

12. General Provisions

12.1 The School’s staff shall not be responsible for students outside their scheduled lesson times or outside the pool area.
12.2 Parents/guardians are required to notify the School promptly of any change in contact details to ensure timely communication in emergencies.
12.3 The School reserves the right, at its sole discretion, to substitute or amend coach assignments. Feedback from parents/guardians is welcome but not binding
